Terms of Use

These Terms of Use ("Terms") form a legally binding agreement between you and TheraPal ("TheraPal," "we," "us," or "our") governing your access to and use of the TheraPal mobile application and related websites and services (collectively, the "Services").

1. Description of the Services

1.1 Features

TheraPal may provide features including, without limitation:

• AI chat companion with supportive, CBT-informed conversational style
• Mood tracking and insights
• Journaling (with optional AI insights on paid plans)
• Breathing exercises, grounding tools, and sleep wind-down aids
• Habit / streak tracking
• Thought records, psychology glossary, and related tools (plan-dependent)
• Crisis resource surfacing and local risk-detection prompts
• Local data export and deletion controls

1.2 Availability

Services are offered for Android via Google Play as published.Features may require internet connectivity (especially AI features). Availability may vary by region, device, OS version, and store policies.

1.3 Updates

We may modify, suspend, or discontinue features at any time. You are encouraged to keep the App updated for security and reliability.

2. Eligibility

2.1 Age

You must be at least 13 years old (or the minimum digital consent age in your country, if higher) to use the Services. If you are under the age of majority, you represent that you have parental/guardian permission where required.

2.2 No Account Required

TheraPal is designed without mandatory user accounts. Access is typically device-local. Purchases and restorations are handled through Google Play accounts and store systems.

2.3 Your Responsibility

You are responsible for your device security, backups, and any activity occurring through your use of the App on your device.

3. AI Features — Specific Terms

3.1 Nature of AI Output

AI responses are generated automatically and may be inaccurate, incomplete, biased, or inappropriate. Outputs are for general informational and reflective support only. They are not clinical advice, diagnosis, prognosis, treatment plans, or medication guidance.

3.2 Prohibited Reliance

You agree not to rely on TheraPal for:

• Emergency response or suicide prevention as a sole resource
• Medical, psychiatric, or pharmaceutical decision-making
• Legal, financial, or other professional advice

3.3 Content You Submit

You retain ownership of content you create in the App. By submitting content to AI features, you grant us a limited license to transmit that content to our AI providers solely to generate a response for you. See the Privacy Policy for details.

3.4 Safety Layer

The App may include automated risk detection and crisis resource panels. These tools are supportive aids, not guarantees of detection or intervention. Absence of a crisis panel does not mean risk is absent. Always use human emergency services when needed.

4. Free and Pro Subscriptions

4.1 Free Tier

Free access may include limited AI usage, limited journal/habit capacity, selected breathing patterns, mood logging, grounding, sleep basics, and always-on crisis resources. Limits may change with reasonable notice in the App or store listing.

4.2 Pro / Premium

Paid subscriptions (for example weekly, monthly, yearly) may unlock unlimited AI chat, expanded journaling and AI insights, advanced insights/analytics, additional tools (such as thought records and dictionary), and the full breathing library, as described at purchase time.

4.3 Billing

Purchases are billed by Google through your Google Play account and may be managed via RevenueCat entitlements.Prices may change for future periods as permitted by store rules.

4.4 Cancellation & Refunds

Cancel anytime in your Google Play subscription settings. Cancellation typically takes effect at the end of the current billing period. Refunds are governed by Google Play policies; TheraPal cannot issue store refunds directly in most cases.

4.5 Non-Paywalled Safety

Crisis resources and core safety affordances will not be gated behind a subscription.

5. Acceptable Use

You agree not to:

• Use the Services for unlawful, harmful, abusive, or exploitative purposes
• Attempt to reverse engineer, scrape, overload, or disrupt the Services or AI providers
• Misrepresent AI output as professional clinical advice
• Use the Services to develop competing models by systematically extracting outputs
• Circumvent subscription, rate limits, or security controls
• Upload malware or content that infringes others' rights

6. Intellectual Property

TheraPal owns the App software, branding, UI, and original content (excluding your personal entries and third-party components). We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

7. Privacy

Our Privacy Policy explains local-first storage, AI processing, subscriptions, and diagnostics. By using the Services, you acknowledge that policy.

8. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI OUTPUTS WILL BE ACCURATE, SAFE, OR SUITABLE FOR YOUR SITUATION, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THERAPAL AND ITS AFFILIATES, OFFICERS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; OR ANY LOSS OF DATA, PROFITS, GOODWILL, OR OTHER INTANGIBLE LOSSES; ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICES OR RELIANCE ON AI OUTPUTS — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) FIFTY US DOLLARS (USD $50).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.

10. Indemnification

You agree to defend, indemnify, and hold harmless TheraPal from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Services, your content, or your violation of these Terms or applicable law.

11. Termination

You may stop using the Services at any time by uninstalling the App and canceling subscriptions via the store. We may suspend or terminate access for violations of these Terms or to protect users or the Services. Provisions that by nature should survive (disclaimers, liability limits, indemnity, IP) will survive termination.

12. Store Terms

If you download from Google Play, you also agree to applicable Google Play terms. Google is not responsible for maintenance, support, or warranties for TheraPal beyond what their standard store rules require. Claims related to the App are between you and TheraPal, not Google, except as required by store policies.

13. Changes to Terms

We may update these Terms periodically. The "Last Revised" date will change accordingly. Continued use after changes become effective constitutes acceptance where allowed by law. If you disagree, stop using the Services.

14. Governing Law

These Terms are governed by the laws applicable in the jurisdiction where TheraPal operates, without regard to conflict-of-law principles, except where mandatory consumer protections in your country of residence apply and cannot be waived.

15. Miscellaneous

These Terms and the Privacy Policy are the entire agreement regarding the Services. If any provision is unenforceable, the remainder remains in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
